Entek Micro LLC's Acceptable Use Policy and TOC

Agreeing to Entek Micro LLC's Acceptable use Policy and Terms of Conditions is mandatory for Hosting signing up or using our services.

Terms of Conditions

Billing

At this time we bill annually (1 year). If you are not satisfied within your first 30 days we would be happy to provide you with a full refund. We accept Visa and Master Card via paypal.com. We also accept money orders. Please note that we will setup your account and email your login information upon receipt of payment. There would be $5 charge for each GIG (1000 MB) Data Transfer over use of the account.

Non-U.S. Clients: Non-U.S. clients are encouraged to pay by credit card as it is the easiest way to handle payment at this time. However, if you would like to pay some other way, please let us know and we will do our best to accommodate you.

Delinquent Accounts: Your email billing will notify you of the due date for your payment. If payment is not received by that due date, we will suspend your account. We will then notify you of this via email. If we still do not hear from you within two weeks we will automatically delete your account from our servers.

If you know that you are going on vacation (or will be away for an extended period of time) and a billing cycle is approaching you need to notify us in order to make other payment arrangements or pay ahead of time. We will work with you, but we must be notified or else you risk losing your account. With as many accounts as we have, we would rather spend time helping clients with hosting issues or adding new features to our services than chasing payments. So, please, make every effort to submit payments in a timely manner.

Account Cancellations:  When you need to cancel an account, please email billing@entekmicro.com and our billing representative will be in touch with you about reimbursement, if it is applicable to your situation.

Entek Micro LLC will send you an email reminder one month prior to your hosting account renewal date. Should you decide to stay with Entek Micro LLC for hosting, simply do nothing and we will continue to bill you as normal. If you would like to cancel, please reply to our email and let us know that you would like to cancel. Should you decide to cancel your hosting account after we have debited your credit card for the next billing cycle there will be a penalty fee of one month's hosting service deducted from your refund. There are no exceptions.

Acceptable Use Policy

All services provided by Entek Micro LLC may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Entek Micro LLC and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken.

Pornography is prohibited on all Entek Micro LLC servers

This includes sites that include sexually explicit or hardcore images and/or advertising. We do not have a problem with sites of an adult nature, but we do not allow pornographic sites. If you think your site may violate our Terms Of Service, please ask us before signing up for an account so that we may determine if we can host your site. Entek Micro LLC reserves the right to determine what is and what isn't acceptable for our servers.

Illegality
In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material.

Undesirable Content
Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work.

Bulk Email
The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.

Misuse Of Resources
Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum.

If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.

Accounts Reinstatement:

Accounts and domains deleted or cancelled due to violation of our acceptable use policy cannot be reinstated.

Refusal of Service:

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

LIMITATION OF LIABILITY:

Entek Micro LLC shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Entek Micro LLC servers going off-line or being unavailable for any reason whatsoever. Furthermore, Entek Micro LLC shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Entek Micro LLC servers. All damages shall be limited to the immediate termination of service.

Violations of these Acceptable Uses Policies should be referred to abuse@EntekMicro.com.
All complaints will be investigated promptly.

DISCLAIMER:

Entek Micro LLC cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Entek Micro LLC are resold. Thus, certain equipment, routing, software, and programming used by Entek Micro LLC are not directly owned or written by Entek Micro LLC. Moreover, Entek Micro LLC holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Entek Micro LLC sees fit.

FURTHERMORE, Entek Micro LLC retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
